1. INTRODUCTION & NETWORK STRUCTURE

The ABN CONSULTING network is composed of three legally independent law firms (hereinafter "ABN CONSULTING," "we," "us," or "our"):

  • ABN Consulting PLLC, a Delaware professional limited liability company, with its office located at 300 Delaware Ave, Wilmington, DE 19801, USA.

  • ABN Consulting SA, a Swiss corporation, with its office located at 1 Rue de la Cité, 1204 Geneva, Switzerland.

  • ABN Consulting SA, an Ivorian corporation, with its office located on Rue Catherine Amon d'Aby, Plateau, Abidjan, Côte d'Ivoire.

This Privacy Policy applies to the personal data processed through our shared website, abnconsulting.net (the "Site"), which is operated jointly for the purpose of prospecting. Crucially, when you formally engage one of the entities through a letter of engagement, your client data is processed solely by the engaged firm, under its exclusive professional responsibility and the secrecy obligations of its local bar association. The other network entities do not have access to this client data without your explicit, written consent.

We are committed to protecting your personal data in accordance with applicable laws, including:

  • The Delaware Personal Data Privacy Act (DPDPA), as amended by House Bill 380 (effective 2026) .

  • The Swiss Revised Federal Act on Data Protection (nFADP) of September 1, 2023 .

  • The Ivorian Law n°2013-450 of June 19, 2013, on personal data protection.

2. DEFINITIONS

5. DATA RETENTION POLICY

5.1. General Retention: 12 Months
Personal data collected via the Site (e.g., from an inquiry form) is retained for a period of twelve (12) months from the date of collection. This period is reasonably necessary to manage follow-up communications with potential clients and is followed by secure deletion or anonymization .

5.2. Client Data Exception
This 12-month policy applies only to pre-engagement data. Once a formal attorney-client relationship is established with an ABN CONSULTING entity, your data becomes part of the client file, which is governed by a strict 10-year retention policy. This is required to meet our professional obligations for record-keeping and conflict-of-interest checks under bar rules (e.g., Delaware Lawyers' Rules of Professional Conduct Rule 1.15).

6. YOUR RIGHTS

You have the following rights regarding your personal data:

  • Right to Access & Portability: Obtain confirmation of processing and a copy of your data in a portable format .

  • Right to Rectification: Correct inaccurate data.

  • Right to Deletion: Request deletion of your data, subject to legal retention obligations .

  • Right to Opt-Out: Opt-out of the processing of your data for analytics.

We will respond to your request within 45 days as required by the DPDPA, or within 30 days as required by the nFADP. An appeal process is available.

7. COOKIES AND SIMILAR TECHNOLOGIES

Our Site uses a cookie consent management platform. No non-essential cookies (analytics, tracking) are placed on your device without your prior, affirmative consent. You can manage your preferences or withdraw your consent at any time via the "Cookie Settings" link in the footer of our Site.

8. DATA SECURITY

We implement reasonable administrative, technical, and physical safeguards to protect your personal data, including encryption in transit (TLS 1.3) and at rest (AES-256), access controls, and regular security assessments by our IT providers.

9. INTERNATIONAL DATA TRANSFERS

As a multi-jurisdictional network, personal data you submit via the Site may be accessible by our support staff in the USA, Switzerland, and Côte d'Ivoire to process your inquiry. Any such transfer is governed by an Intra-Network Data Processing Agreement that includes Standard Contractual Clauses to ensure an adequate level of protection. For transfers from Switzerland to the USA, we rely on the Swiss-U.S. Data Privacy Framework (DPF) where applicable, or on Standard Contractual Clauses as an appropriate safeguard . Formal client files are never shared between entities without your explicit consent.

10. JURISDICTION-SPECIFIC NOTICES

  • For Delaware Residents (DPDPA): We do not process personal data of consumers we know to be under 18 years of age for targeted advertising, nor do we sell data . You have the right not to receive discriminatory treatment for exercising your privacy rights. If your appeal is denied, you may file a complaint with the Delaware Department of Justice.

  • For Swiss Residents (nFADP): Our representative in Switzerland is ABN Consulting SA, 1 Rue de la Cité, 1204 Geneva. You may object to processing at any time. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) .

  • For Ivorian Residents: In accordance with Law n°2013-450, your prior, free, and informed consent is required for all non-essential cookies. You may direct any complaints to the ARTCI.

11. CHANGES TO THIS PRIVACY POLICY

We will update this policy as needed. Material changes will be communicated via a banner on the Site prior to the change becoming effective.
